It applies to information gathered through Services. The following subsections serve as Pophouse's Notice at Collection under applicable US privacy laws, including the California Consumer Privacy Act ("CCPA").
12.1 Collection of Personal Information
In the preceding twelve (12) months, we have collected the following categories of personal information (note that not all categories may be collected about every individual):

We also collect Social Media User Content Data such as any social media information that you have shared publicly, social media handle, and comments or messages you have shared with us on social.

Audio, Electronic, Visual, or Similar Data such as in-store Closed-Circuit Television ("CCTV"), photographs you upload for product customization, customer experience calls, and data collected through in-store analytics platforms which may include video recordings, WIFI signals, sensor data, and other technologies to understand customer traffic patterns, engagement, and store performance.

Inferences drawn from or created based on any of the information identified above.

Professional or Employment-Related Information such as employer or associated business, job title, work email (as described below), and quotes submitted.

Sensitive personal information (in limited circumstances). While Pophouse does not collect or process precise geolocation through our websites, our service providers may collect such information to find a store near you using your location data which may be considered "sensitive personal information" or "sensitive data" within the meaning of US privacy laws. Pophouse does not ask you to provide, and we do not knowingly collect, any sensitive personal information from the typical consumer as part of the Services. In very rare circumstances, Pophouse does ask that you provide us with sensitive personal information in the form of a 1099 form solely for the purpose of legal matters to allow us to facilitate sweepstakes and giveaways of Pophouse products above a certain monetary value.
We also collect limited personal information (including name, job title, telephone numbers, and email address) from our business contacts, vendors, and contractors for the purpose of initiating, operating, managing, and maintaining our business relationships. We collect personal information from our ambassadors including contact information, user-generated content, professional or employment-related information, and other information you provide to us to manage the ambassador program.
12.2 US Specific Sources of Personal Information
In addition to the general sources outlined in our global Privacy Policy, we automatically collect certain personal information in the US through specific means:

Session Replay: Our websites may utilize technology often known as "session replay" technology that allows Pophouse to understand how users interact with our websites, including replays of interactions with our websites. By using our Services, you represent you have read this disclaimer and understand that Pophouse may use this session replay technology to record how you interact with our websites, including clicks and curser movements, which may be used by Pophouse for our own internal analytical purposes, fraud prevention, and to improve and enhance our websites.

Video Data: We also use CCTV cameras to collect and retain for a limited duration, images of our people in our stores for fraud detection, theft prevention, and security.

Other Technologies in our Venues and Retail Stores: We have deployed WIFI access points and sensors in some of our stores, and we receive aggregate reports regarding store traffic that relies in part of information collected from the WIFI access points and sensors to track traffic patterns in our stores. If you wish to exclude your device from such in-store mobile analytics, you can opt out at any time by turning off WIFI on your device.
12.3 Disclosures of Personal Information (Including "Sales" / "Sharing" and Targeted Advertising)
In the preceding twelve (12) months, Pophouse has disclosed all of the CCPA categories listed above for a business purpose to Pophouse Affiliates, Service providers (including AI-assisted image creation tools, chat support, payment processors, and fraud prevention), Consultants/advisors, Analytics/marketing/advertising partners, Joint marketing and business partners, and entities involved in business sales or legal compliance.
12.4 Targeted Advertising and "Sales" / "Sharing" of Personal Information: We do not sell consumers' personal information for money. However, some US state laws broadly define "sales", and certain sharing activities described below may therefore be considered a sale under certain privacy laws even though we do not receive any financial compensation from third parties in exchange. Instead, we do share certain personal information with third parties for their own purposes in exchange for insights, certain rights, and other valuable services, such as with direct mail and other marketing partners to expand our brand outreach, and with leagues, teams and other business partners to license, sell and promote products.
We also share personal information with third parties for the purpose of cross-contextual (or interest-based) behavioral advertising (known as "sharing" under the CCPA) or for "targeted advertising" i.e., displaying advertisements to you based on personal information collected or inferred from your activities over time and across nonaffiliated websites, applications, or online services. In the preceding twelve (12) months, Pophouse has "sold" or "shared" Identifiers, Contact Information, Commercial or Transaction Data, Device and Network Data, and Usage Data with Analytics, Marketing, Advertising, and Business Partners for these purposes. (Note that we do not disclose, "share" or "sell" text messaging opt-in data, mobile numbers or consent with any third parties for marketing purposes).
12.5 Third Party Services & Resale Operations
We use third-party payment providers and facilitators (such as Adyen) including certain Buy Now, Pay Later providers (such as Affirm and Klarna), to process payments made through the Services, as well as for anti-fraud purposes. We also partner with our resale partners to power and manage our Pophouse branded resale site; our resale partners provide the technology and operational infrastructure and enable us to offer seamless resale experience, including account management, product listing, order fulfillment, and customer support. When you engage with our Pophouse branded resale site, our resale partners may collect and process certain personal information on our behalf to facilitate these services, including contact details, account data, shipping information, and purchase history. Please note that your resale account used for our Pophouse branded resale site is separate from your Pophouse account and may be handled differently.
12.6 US State Privacy Rights
If you are a resident of Alabama (effective 2027), California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oklahoma (effective 2027), Oregon, Rhode Island, Tennessee, Texas, Utah, or Virginia you may have the right to request us to complete the following legal privacy rights:

Opt Out of Targeted Advertising, Sharing and Sales: Residents of the states listed above may also have the right to opt-out of the processing of personal information for the purposes of targeted advertising and of the "sale" / "sharing" of your personal information (as defined under the CCPA). You may opt out using any opt out forms or links in our Services or by emailing us at dpo@pophouse.com. You may also opt-out of "sales" / "sharing" or targeted advertising conducted via cookies and similar technologies on one of our websites by enabling a legally recognized opt-out preference signal, such as GPC, and visiting that website on such browser.
Appeals: With the exception of California and Utah residents, residents of the US states listed above have the right to appeal a decision with regard to their privacy request-for example, you may appeal our decision to refuse or decline to take action on a request. California "Shine the Light": California's Shine the Light Law allows California residents to request a list of the "third parties" to which the business has disclosed certain "personal information" during the preceding calendar year for the third parties' own "direct marketing purposes". However, a business is not required to provide this information where the business adopts and discloses a policy of not disclosing "personal information" to "third parties" for their "direct marketing purposes" 1) unless the customer first affirmatively agrees or 2) if the customer has exercised an option that prevents that information from being disclosed for such purposes. Pophouse maintained and maintains such a policy and thus is not required to provide this information.

Profiling: Note that Pophouse does not use personal information for "profiling" for which certain US privacy laws require a "profiling" opt-out.

Use By Minors: Our Services are not intended for or directed at individuals under the age of 18. We do not knowingly collect or request personal information directly from individuals under the age of 18. We do not knowingly "sell" / "share" (as those terms are defined under the CCPA and other US privacy laws) the personal information of consumers under 18 years of age.
Notice of Financial Incentive / Bona Fide Loyalty Program Disclosure: Pophouse offers our customers certain perks, rewards, exclusive offers, and other benefits that can result in superior prices, rates, levels or selections of products and services, such as our military and first responder and friends and family programs or exclusive rewards for account sign-up. These offerings may constitute "financial incentives" or "bona fide loyalty programs" under certain state privacy laws (collectively "Financial Incentive Programs" or "Programs").
Participation in our Programs is voluntary and requires your prior opt in consent. Your participation in any Financial Incentive Program is optional, and you may withdraw from the Program at any time by following the instructions in the applicable Program's terms, or by contacting us at dpo@pophouse.com to delete your account or remove yourself from the Program.
When you sign up for one of these Programs, we may ask you to provide your contact details and other categories of personal information to provide the benefits, including the following: identifiers (like your name), contact information (like your email address), demographic data, commercial or transaction data (like your purchase history), account data, behavioral and preference data (like your purchase and product preferences and interests), professional and employment-related information, and inferences drawn about your preferences.
